The issue of the registry of Flat Buyers trapped in the perch of the Super Area and Covered Area remains a matter of discussion these days. From the court order to the Stamp Act, registration of a flat on a super area is not considered in the interest of buyers. According to experts, due to this screw of the super area, not only the stamp of Noida’s buyers is not only unnecessarily bearing the stamp, but the authority to make a flat TM (Transfer Memorandum) from the authority has to be charged only on the super area. Due to this, the flat buyer has to pay about 7-8 lakh rupees more than the price of the flat.
Understand the pain of Noida’s flat buyers
If a society of Noida takes a flat of 2000 square feet for Rs 80 lakh and the circle rate of that area is 4000, then a stamp paper of Rs 4 lakh will be required to register on the super area. About 50 thousand rupees will be incurred for registering other expenses. That is, your registration was done for 4.5 lakhs. Also, almost this expenditure will be incurred by the authority to get TM, because, in the entire state, Noida is the only place where land is not freehold. Every time a flat will be sold, the same as the registry will have to be submitted to the TM Charge Authority. That is while taking a flat of 80 lakhs, the flat owner will pay 80 lakh rupees and the expenditure of 8-10 lakhs will be spent in getting the registry and TM. If this registry is on the rule of covered area plus 20% extras, then you will save 3-4 lakh rupees in the cost of 8-10 lakhs. Bayer Chakres Jain, who raised the issue of super and covered areas, says that it is going to get more than Rs 3-4 lakh from Bayer’s pocket just because the act was implemented with clear guidelines without any confusion and over the years Is driving there. Due to this, Bayer’s pocket is being cut not in one place but in two.
Buying a flat is cheaper in Ghaziabad
If you take this 80 lakh flat in the neighboring district of Ghaziabad, then due to the super area on registration there, your pocket will be cut, but the GDA will not have to pay TM charge because the land in Ghaziabad is freehold. Alok Singh, who has been active in Ghaziabad for the past several years for the Apartment Act, says that the battle of super area and cover is justified. This is not only an injustice to the buyers of Noida but also to the buyers of Ghaziabad, but we have more injustice with the buyers of Noida as they have to give TM charge to the authority only on the super area. That is because the registry is being done in the super area.
Registry is wrong on super area
RERA member and former IAS Balwinder Singh said that the Supreme Court has also ruled that the registry on the super area is wrong in its comments on the issue. RERA has not yet issued any guidelines on the issue, but it is clear that there should not be a registry on the super area as the builders from the authority pass the map on the covered area. According to the Act, the registry covered area should be based on the rule of 20 percent extras. It is also known as carpet area. RERA has now instructed the builders in their guidelines that they do not have to sell flats on the super area in the builder buyer agreement; they have to sell on the carpet area.
Buyers now await justice About 25 days ago, the district administration issued a letter directing the registration of Amrapali Zodiac based on the rule of covered area plus 20 percent extra area. In this letter, it was also clearly written that if there is a registry of the flat on the super area, then the concerned authority should map it and clarify the super area in the sublease. Since then, the registry of the flats in the Registry Department has stopped at present and according to the information, the Authority has kept silent on signing the sublease. At the same time, buyers are waiting, now clear guidelines should be applied on this.
